REPRESENTATIVE MATTERS

  • Represents individuals and corporations in evaluating potential trade and service marks, prosecuting state and federal applications for trade and service marks, and enforcing trademark rights against others.
  • Represents individuals and corporations in Trademark Trial and Appeal Board proceedings, including Oppositions and Cancellations.
  • Represents individuals and corporations in enforcing their trade and service mark rights against cybersquatters in domain name disputes under ICANN’s Uniform Domain Name Resolution Policy.
  • Advices individuals and corporations on regulatory and compliance matters.
  • Advices individuals and corporations on employment matters, including employment agreements, non-compete agreements, and service contracts.
  • Frey, et al. v. Varghese, et al. The firm represents two directors, one the sole member, of Pineville Community Health Center, Inc. and the defendants in the breach of fiduciary duty litigation; the firm has successfully defeated a motion for preliminary injunction and continues to represent defendants.
  • Gibson, et al. v. Garmin International Inc., et al. The firm represents Garmin International in a series of related strict tort product liability actions stemming from a boating accident on Lake Cumberland.
  • Allegro Home Delivery v. Elite Warehousing, et al. The firm represents AHD asserting fraud, fraudulent misrepresentation, negligent misrepresentation, and various equitable claims against Elite Warehousing, Inc; the firm has successfully defeated a summary judgment motion and continues to represent AHD.
  • T.D. v. Jefferson County Public Schools, et al. The firm represents JCBE defending against various claims including violation of Kentucky Civil Rights Act of 1966, negligent supervision, and negligent infliction of emotional distress.
  • Luckhardt v. Payne, et al. The firm represents New Albany Floyd County Consolidated School Corporation against a host of negligence claims that arose from a student’s injury that occurred while attending the school’s softball team practice.
  • Jaclyn Evans, Mother and Next Friend of D.E., a Minor v. Jefferson County Board of Education, et al., Case No. 24-CI-006192 (Jefferson Cnty. Ky. Cir. Ct. 2024).  The firm obtained dismissal in favor of JCBE regarding a host of negligence and breach of contract claims that arose from altercations between students while riding on a school bus.
