Buck Dougherty is a member of the Wyatt Tarrant & Combs Bankruptcy & Creditors' Rights Service Team.  He concentrates his practice in the areas of commercial litigation, insolvency, and commercial bankruptcy with a focus on representing creditors under the Uniform Commercial Code.  He has extensive experience as a national and regional lead counsel for clients, including representing secured lenders, lessors, and other secured creditors in commercial creditors' rights litigation and alternative dispute resolution.  His experience in this area included recovering collateral for secured creditors and lessors, obtaining temporary and permanent injunctions and protective orders, foreclosing security interests, utilizing pre- and post-judgment remedies, pursuing and enforcing judgments in commercial matters, and negotiating and documenting work-outs and out-of-court debt restructurings.   Mr. Dougherty has also served as lead counsel in construction litigation, general business litigation and employment law matters.

Representative Matters

  • Represented a Fortune 500 company and equipment finance lender in negotiating the voluntary surrender of two Lear jets originally valued at approximately $9 million and prosecuted in state court the remaining deficiency balance.
  • Represented a leading international used-car wholesale inventory floor-plan lender in the repossession and seizure of large-scale financed inventory.
  • Represented and defended two multinational agricultural companies in state court and obtained a dismissal of the case against the clients, in a dispute involving the application of the federal Food Security Act of 1985 and competing state law agricultural lien/security interests.
  • Represented and defended a physician in state court in an action brought by the phisician's former physician practice group for the alleged violation of a non-compete agreement and  a dismissal of the case against the physician and the awarding of attorneys' fees.
