Kacey Faughnan is a member of the Firm's Litigation & Dispute Resolution Service Team.  She concentrates her practice in all areas of commercial litigation in both federal and state courts.

Representative Matters

Ms. Faughnan has experience defending clients in a variety of different areas of commercial litigation.  She counsels and represents clients in class actions, interference with business cases, breach of contract matters, breach of fiduciary duty actions, products liability suits, and other complex litigation.  Some of her representative matters include:

  • Clear Channel Outdoor, Inc. v. A Quality, Inc. d/b/a/ Mr. Pride, et al. (Tenn. Ct. App.). The Tennessee Court of Appeals affirmed the trial court's decision that defendants owned a billboard based on the clear, unambiguous language of a lease agreement.
  • Solis, et al. v. First Financial Bank (W.D. Tenn.). The Court dismissed plaintiffs' claims of conversion/trespass and violations of the Tennessee Consumer Protection Act for lack of subject matter jurisdiction. The case involved stored value accounts opened with defendant by a third-party for the purpose of wage compensation.
  • The Gurley Properties, L.P., et. al. v. Memphis Light, Gas & Water Division, et al. (Shelby County Circuit Court). The Court denied certification of a purported class of property owners objecting to the addition of cellular telephone transmission equipment to utility transmission towers on easements burdening plaintiffs' properties.
