Representative Matters

  • Appalachian Regional Healthcare, Inc. v. Coventry Health and Life Ins. Co., Case No. 5:12-CV-114 (W.D. Ky.): Assisted in obtaining a preliminary injunction and other favorable rulings on behalf of healthcare providers in litigation arising from Kentucky’s Medicaid managed care system.  Defendants’ appeal of the preliminary injunction was dismissed by the Sixth Circuit Court of Appeals.  Appalachian Regional Healthcare, Inc. v. Coventry Health and Life Ins. Co., 714 F.3d 242 (6th Cir. 2013).
  • Libertarian National Committee, Inc. v. Holiday, 2014 WL 511583, Case No. 14-63-GFVT (E.D. Ky.): Part of a team that successfully defended a public broadcaster from a motion for preliminary injunction brought by a United States Senate candidate demanding an appearance on a televised forum.
  • Commonwealth of Kentucky v. Samaritan Alliance, LLC, ___ S.W.3d ___, Case No. 2012-CA-00745-MR (Ky. Ct. App. 2014): Served as special counsel to the bankruptcy estate of Samaritan Hospital in a lawsuit against the Commonwealth of Kentucky arising from Medicaid under-reimbursements.  Successfully defended against the Commonwealth’s motion to dismiss before the trial court and on appeal.
  • John Conti Coffee Co. v. MAPCO Express, Inc., Case No. 3:13-CV-39-GFVT (E.D. Ky.): Obtained order dismissing plaintiff’s trademark infringement claims in full on grounds of lack of personal jurisdiction.
  • Represented an institution of higher education in Open Records and Open Meetings actions before the Kentucky Attorney General, the Jefferson Circuit Court, and the Kentucky Court of Appeals.
  • Buridi v. Branch Banking & Trust Co., Case No. 3:12-CV-00486 (W.D. Ky.): Obtained order granting summary judgment on all of plaintiff’s claims in lender liability action arising from a commercial construction loan.
  • Assisted in obtaining a temporary restraining order and preliminary injunction to enforce an employee’s non-competition agreement on behalf of a Louisville business.
